Welcome to Moonshot Endeavors Limited, doing business as Suitcase Designs (“Suitcase Designs,” “we,” “us,” or “our”). These Terms of Service (“Terms”) outline the terms governing your use of our website design services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please refrain from using our Services.
Suitcase Designs provides various website design services, which include:
Custom Website Design and Development: Tailored website design based on specific client needs, including consultation, design mockups, development, and final launch.
Customizable Website Design with Tailored Frameworks: Website creation using our proprietary frameworks, regularly redesigned to offer a fresh, customized look aligned with each client’s brand and content.
Annual Maintenance and Support: Year-round website support, including software updates, security monitoring, and content updates.
Domain Registration and Hosting: Domain registration and website hosting on SiteGround servers, ensuring reliability and security.
All websites are developed using WordPress.
All websites designed by Suitcase Designs require an active maintenance plan to ensure security, performance, and ongoing support. Maintenance includes:
Domain registration and renewal (with privacy)
Hosting on SiteGround servers
Elementor Pro license access
Daily backups and regular updates
Security monitoring and speed optimization
Technical support and minor content updates
Subscription Packages: Maintenance is included as part of the monthly or annual subscription fee.
Lump Sum Packages: An active maintenance plan is mandatory for all Lump Sum Packages. Clients may choose to pay monthly or annually at the then-current rate. Maintenance renews automatically unless canceled in writing at least 30 days prior to renewal. Failure to maintain an active maintenance plan will result in immediate suspension of hosting, security, backups, and support services.
A. Subscription Packages
Clients may choose a monthly subscription (12-month minimum) or an annual prepay subscription.
Subscriptions include maintenance and automatically renew at the then-current rates unless canceled in writing 30 days prior to renewal.
Early termination does not release payment obligations.
Payments are processed automatically through Stripe. Clients are responsible for maintaining valid payment methods. Failed payments not resolved within 7 days may result in suspension of services.
B. Lump Sum Packages
One-time upfront fee covers design and build.
An active maintenance plan is required and billed separately (monthly or annually).
The design/build fee and the first maintenance term (monthly or annual) must both be paid in full before work begins.
Maintenance is continuous and renews automatically at the then-current rate unless canceled in writing 30 days prior to renewal.
Clients are entitled to two rounds of revisions for each website design, including two revision sync meetings. Additional sync meetings can be purchased if needed. Routine updates are included as part of the subscription, but new pages or total redesigns are subject to the full cost for Lump Sum Packages. Subscription packages include a yearly redesign opportunity. Final approval from the Client is required before the website is launched. Revisions after launch are limited to copy or photo updates; design revisions after launch are subject to the full price per page listed on our website. Clients must request revisions within 14 days of receiving the initial design. Failure to request revisions within this period may result in additional charges.
No-Show and Late Cancellation Fee: A $50 fee applies for no-shows or cancellations made within 24 hours of a scheduled meeting.
Clients are responsible for providing all necessary materials (content, images, etc.) promptly and ensuring they comply with copyright laws. Existing websites will be migrated to our hosting. Delays or additional charges may result from non-compliance.
Both parties agree to maintain confidentiality regarding any proprietary information shared. Suitcase Designs does not sell or disclose client information.
Both parties agree to comply with data protection regulations. Suitcase Designs will take reasonable measures to protect personal data against unauthorized access.
Suitcase Designs provides services “as is” and “as available” without warranties, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free service or specific results from SEO or third-party integrations.
Suitcase Designs is not liable for indirect, incidental, or consequential damages related to the use of our Services. Our liability is limited to the total fees paid by the client.
Clients agree to indemnify Suitcase Designs and its affiliates against claims arising from their use of our Services or any breach of these Terms. This obligation survives termination of these Terms.
These Terms are governed by the laws of Colorado, without regard to conflict of laws principles.
Suitcase Designs will not be liable for failure to fulfill its obligations if due to causes beyond reasonable control, including but not limited to natural disasters, war, or government restrictions.
Suitcase Designs may amend these Terms at any time. Clients will be notified via email and website updates, and continued use of our Services indicates acceptance of any amendments. Maintenance plan rates and subscription fees are subject to change upon renewal, with at least 30 days’ prior notice.
These Terms represent the entire agreement, superseding prior agreements or representations.
If any provision is deemed unenforceable, the remaining terms will remain effective.
Failure to enforce any right or provision does not constitute a waiver of that right or provision.
Suitcase Designs will implement security measures to protect client data. Clients are responsible for keeping login credentials secure and must notify Suitcase Designs of unauthorized access immediately.
Suitcase Designs may integrate third-party services but is not liable for their performance.
Suitcase Designs does not guarantee specific outcomes from SEO or third-party integrations but will strive for the best results.
